Terms and Conditions

 

1. Definitions

1.1. Buyer – A natural person or Representative purchasing goods from the Seller or having entered into a contract with the Seller for the purchase of goods.

1.2. Seller – The Amberell online store, email address: info@amberell.lt.

1.3. Online Store – The e-commerce platform located at www.amberell.lt. www.amberell.lt

1.4. Business Day – Any day of the week except Saturday, Sunday, and public holidays officially recognized as non-working days under the laws of the Republic of Lithuania.

2. General Terms

2.1. By placing an order confirms that the Buyer understands and agrees to abide by these terms (hereinafter referred to as the Rules).

2.2. These Rules are prepared in accordance with the Civil Code of the Republic of Lithuania, the Consumer Rights Protection Act, the Electronic Commerce Directive, and other applicable legal acts.

2.3. The Rules regulate the rights, obligations, and responsibilities of the Buyer and the Seller when purchasing goods in Amberell online store.

2.4. The right to purchase goods in the online store is granted to:

i) Adults whose legal capacity has not been restricted by a court decision;

ii) Minors aged 14 to 18, with parental or guardian consent, except in cases where they manage their own funds independently;

iii) Legal entities;

iv) Authorized representatives of the aforementioned individuals.

2.5. The purchase agreement comes into effect when the Buyer forms a shopping cart, provides the required information, selects a payment method, reviews the Rules, and clicks "Confirm Order."

2.6. All agreements between the Buyer and the Seller are stored in the online store's system.

2.7. The product specifications, quantities, prices, and other conditions indicated at the time of the order become part of the contract upon receiving the order confirmation via email.

2.8. Once the contract is concluded, the conditions specified at the time of the order are binding on both parties and can only be amended according to the procedures set out in these Rules.

3. Buyer's and Seller's responsibilities

3.1. The Buyer is fully responsible for ensuring that the information provided in the order is accurate and assumes all consequences arising from incorrect data.

3.2. The Buyer is responsible for all actions performed while logged into the online store system.

3.3. Protection of registration data is the Buyer's responsibility. If another person uses the registration information, they will be considered as the Buyer.

3.4. The Seller is not liable for losses if they arise because the Buyer did not follow the Seller's recommendations or did not familiarize themselves with these Terms, even though they had the opportunity to do so.

3.5. The Seller's liability for damages arises only if the losses occurred due to the Seller's fault.

3.6. The Seller's liability for compensation is limited to the price of the product(s) ordered by the Buyer.

3.7. The Seller is not responsible for disruptions in the operation of the online store caused by third-party system failures, communication issues, or service interruptions that the online store uses.

3.8. If one party incurs losses due to the fault of the other party, the responsible party must compensate for the damages in accordance with the applicable laws of the Republic of Lithuania.

4. Buyer’s rights and obligations

4.1. The Buyer has the right to purchase goods from the online store in accordance with these Terms.

4.2. The Buyer may return or exchange purchased goods by complying with the conditions set forth in Section 9.

4.3. If the information provided in the Buyer’s registration form changes, they are obligated to update it immediately.

4.4. By using the online store, the Buyer agrees to all provisions of the Terms and undertakes to comply with them.

4.5. If the Buyer refuses to accept the goods at the time of delivery without a valid reason, they must reimburse the Seller for the delivery costs.

4.6. The Buyer is obligated to keep their online store login information secure and not share it with third parties. If the login information is lost, the Buyer must immediately inform the Seller using the contact details provided in the online store.

 5. Seller’s Rights and Obligations

5.1. The Seller must ensure the availability of online store services in accordance with these Terms and other conditions published on online store.

5.2. The Seller is obligated to protect the Buyer’s personal information and respect their right to privacy, as indicated in the registration form.

5.3. The Seller commits to delivering the products ordered by the Buyer according to the delivery method chosen by the Buyer, adhering to the conditions specified in the Terms.

5.4. If, due to unforeseen circumstances, the Seller cannot deliver the ordered product, they have the right to cancel the contract, informing the Buyer about it. The Seller may offer an alternative product, and if the Buyer refuses, the amount paid will be refunded within 5 business days.

5.5. If the Buyer decides to return a product in accordance with the conditions set forth in Section 9, the Seller must refund the paid amount within 30 calendar days of receiving the product.

5.6. Upon receiving payment confirmation, the Seller is obligated to send the Buyer a shipping confirmation with the dispatch date on the same day (if the order was placed on a business day).

6. Payment Procedure and Product Prices

6.1. The product prices listed in the Amberell online store are shown in euros, including VAT. Delivery costs are not included in the product price and are covered by the Buyer. In certain cases, the Seller may offer free delivery.

6.2. The Seller reserves the right to change the prices of products and services (e.g., engraving, shipping, gift wrapping, etc.) listed in the online store at any time.

6.3. If products are delivered abroad and customs duties or other country-specific taxes apply, these costs are borne by the Buyer.

6.4. The Buyer can pay for the products using the Paysera or PayPal payment platforms, or by entering their bank card details.

7. Order Fulfillment and Product Delivery

7.1. The Seller commits to dispatching the ordered products within 1–2 business days if they are already produced. If the products are still in production, the Seller will inform the Buyer about the production timelines. The order will be fulfilled only when all ordered products are completed, even if their production times vary.

7.2. When placing an order, the Buyer must provide an accurate delivery address and the name of the person receiving the products. If the Buyer or designated recipient cannot accept the order or the address is incorrect, the Buyer cannot file any claims related to these circumstances.

7.3. Products in Lithuania are delivered via registered Lithuanian Post, LP Express, Omniva, or DPD terminals, as well as DPD couriers. For international deliveries, Lithuanian Post, DPD, DHL, or FedEx services are used.

7.4. Delivery costs are paid by the Buyer unless otherwise specified in the order or if the Seller provides free shipping. The Seller always informs the Buyer about delivery conditions and costs.

7.5. The Seller is not responsible for delivery delays if caused by the Buyer or circumstances beyond the Seller's control.

7.6. Upon receiving products with damaged packaging, the Buyer must note this on the courier’s delivery document or complete a damage report in the presence of the courier. If the Buyer does not take these actions, the Seller is not liable for product damage related to the reported packaging issue.

7.7. The Buyer must inspect the product's quality and conformity to the order upon receiving or opening the package. If the products are defective or do not match the order, the Buyer must report this within 30 calendar days using the contact information provided on the online store. After this period, the products are considered to have met the order and quality requirements.

8. Jewelry Quality and Warranty

8.1. Amberell jewelry comes with a 12-month warranty. During this period, the jewelry will be repaired or replaced free of charge if defects are due to manufacturing faults and were not caused by mechanical or chemical damage.

8.2. The Buyer can utilize the warranty service by sending the jewelry to the address provided after submitting an inquiry. The Buyer must inform Amberell beforehand and provide the shipment tracking number.

8.3. To claim the warranty, the Buyer must present the purchase document.

8.4. The Seller will assess the condition of the jewelry within 3–7 working days from the date of receipt and inform the Buyer about possible repair solutions.

8.5. The warranty is not valid if:

i) more than 12 months have passed since the purchase date;

ii) defects occurred due to improper use, mechanical or chemical damage, or natural wear and tear;

iii) the jewelry was repaired by the Buyer or any third party.

8.6. If the defects are determined to be the Buyer’s fault, the repair service may be charged.

8.7. The Buyer may refuse the repair service. If the Buyer agrees to the conditions, the repair will be completed within 30 days.

8.8. Repairs will only commence once the Buyer has prepaid the specified service fee.

8.9. The Seller may refuse to repair the jewelry if:

i) the product is heavily worn;

ii) it is impossible to replace damaged or missing parts;

iii) the repair cost exceeds the value of a new product.

8.10. Breakage of necklace or earring chains or clasps is considered mechanical damage and is not covered by the warranty. The Seller does not offer repairs for broken chains—new chains can be purchased instead.

8.11. Due to the specific nature of paired jewelry (amber selection, inventory management, etc.), it is not possible to produce a single earring—purchasing a new pair is recommended.

8.12. The Seller does not provide repair services for jewelry purchased outside of the Amberell online store.

9. Return and Exchange Policy

9.1. Items purchased from Amberell's online store can be returned or exchanged within 30 calendar days from the date of receipt, meaning when the item was delivered or picked up from a post office/locker.

9.2. If the Buyer receives an incorrect or defective item, Amberell commits to accepting the return and either replacing or repairing the item within 30 calendar days.

9.3. If any defects or issues are discovered, the Buyer must notify the Seller within 30 calendar days. Failure to do so will mean the item is considered to meet the order and quality requirements.

9.4. When returning or exchanging items, the Buyer must provide proof of purchase (e.g., a receipt or bank payment statement). Without this document, returns or exchanges will not be accepted.

9.5. Returned or exchanged items must be undamaged, in their original condition, and fully complete. They must be returned in their original packaging or, if not possible, in a secure package to ensure safe delivery. Items must have their tags attached. If the tag is removed, the item cannot be returned or exchanged.

9.6. Custom-made or personalized items (e.g., size adjustments, engravings, or customized amber) cannot be returned or exchanged.

9.7. Gift bags and cards are considered non-returnable and non-refundable.

9.8. By purchasing items, the Buyer confirms their understanding and agreement with these terms.

9.9. The Seller reserves the right to refuse returned items or to withhold refunds if the Buyer has not followed the specified return and exchange policies.

10. Procedure for Product Exchange and Return

10.1. To return or exchange an Amberell product, please contact us via email at info@amberell.lt

10.2. Until the returned or exchanged item is received by the Seller, it remains the Buyer’s responsibility.

10.3. Upon receiving the returned item, the Seller will assess its condition. If it meets the stated conditions, it will be replaced or the purchase amount will be refunded to the Buyer’s designated bank account within 30 calendar days.

10.4. The Buyer must provide the shipment date and tracking number. If this information is not provided, the item will not be exchanged or refunded.

10.5. If the item is returned from a country outside the European Union, it may be held at customs, potentially delaying the return or exchange process.

10.6. If a quality item is returned or exchanged, all customs duties and other fees are the Buyer’s responsibility. However, if the item was defective, these costs will be covered by the Seller.

10.7. If the returned item is exchanged for a more expensive product, the Seller will contact the Buyer with payment information. If the returned product is cheaper, the Seller will refund the difference to the Buyer’s bank account within 14 calendar days.

11. Conditions for Refund of Shipping and Delivery Costs

11.1. When exchanging or returning quality products, the Buyer is responsible for covering shipping and delivery costs.

11.2. If the returned or exchanged product has a manufacturing defect, the Buyer must contact the Seller via email at info@amberell.lt to arrange the return or exchange terms. In this case, the shipping costs will be covered by the Seller.

11.3. If additional payment was made for product delivery, these costs will not be reimbursed when returning the item. If free shipping was selected, the shipping costs will be deducted from the refunded amount. When exchanging a product, shipping costs will also apply, except when the product is deemed defective.

12. Rules for Using Gift Vouchers

12.1. A gift voucher is a contractual document that grants the right to purchase specific goods or services under the conditions specified on the voucher. The validity period of the voucher cannot be extended, and the value of unused vouchers is not refunded in cash.

12.2. Products purchased using a gift voucher cannot be exchanged for cash.

12.3. The gift voucher itself is non-exchangeable and non-refundable. It functions as an agreement, granting the right to purchase goods or services according to the terms indicated on the voucher.

12.4. A gift voucher with a specified value is valid for 6 months from the date of purchase. The expiration date is clearly indicated on the voucher. The voucher can be used once in Amberell online store.

12.5. The Buyer who purchases the gift voucher may transfer it to another individual or legal entity. The voucher must be used within the specified validity period and can only be exchanged for products or services offered by Amberell. The voucher cannot be converted into cash.

12.6. The gift voucher amount must be used in a single transaction. If the voucher’s full value is not utilized, the unused balance is not refunded.

12.7. Products purchased with a gift voucher are not refunded in cash but can be exchanged for other products within the designated exchange period. If the buyer decides to return the products, the gift voucher will be refunded for the corresponding amount, considering the value of the returned items.

13. Personal Data Protection

13.1. The Buyer can order products in the online store:

i) by registering and providing the required information during registration;

ii) without registering in the online store.

13.2. When placing an order, the Buyer must provide necessary personal data, such as name, surname, delivery address, phone number, and email address, to ensure proper order fulfillment.

13.3. By confirming these terms, the Buyer consents to the processing of the provided personal data for the sale of goods and services, the Seller's activity analysis, and direct marketing.

13.4. The Buyer also agrees to receive important notifications via email related to order processing, payment, and delivery.

13.5. The Buyer may choose whether to receive marketing messages from the Seller and can opt out of receiving such messages at any time.

13.6. The Seller commits not to disclose the Buyer’s personal data to third parties, except when necessary to fulfill the order (e.g., involving delivery services).

13.7. The Buyer agrees to receive newsletters, which can be unsubscribed from at any time by clicking the relevant link in the newsletter.

13.8. By using the online store, the Buyer agrees that:

i) any communication regarding the order will be conducted via email or phone;

ii) necessary information will be shared with courier services if required for delivery.

13.9. The provided data is used solely to verify the Buyer’s identity and fulfill the order, in accordance with the laws of the Republic of Lithuania.

14. Customer Service

14.1. If the Buyer has any questions, comments, or complaints regarding an order, they should contact the Seller.

14.2. The Buyer can contact the Seller using the following methods:

i) By phone: +370 62557222, on weekdays from 09:00 to 18:00;

ii) paštu: info@amberell.lt;

iii) Through the Amberell Facebook page by sending a private message;

iv) By submitting a direct inquiry on the online store.

14.3. The Seller strives to respond to customer inquiries as quickly as possible. Responses on weekdays are provided within 3 business days, and inquiries received on non-business days will be answered within 3 business days from the next working day.

15. Intellectual Property Protection

15.1. The names of products and companies presented in the online store may be registered trademarks. In such cases, their intellectual property is protected according to applicable legal regulations.

15.2. The content of the online store belongs to Amberell and is protected by law. Copying or using the website's content or any part of it without written permission from Amberell is strictly prohibited.

 16. Final Provisions

16.1. The Seller reserves the right to change these terms and related information at any time. Any changes to the terms take effect from the moment they are published in the online store. The terms applicable at the time of order placement will apply to the Buyer.

16.2. If the Buyer disagrees with any changes to the terms, they have the right to reject them; however, in such cases, they lose the right to use the online store's services.

16.3. The Seller reserves the right to temporarily or permanently suspend the operation of the online store without prior notice if important circumstances arise. This does not relieve the Seller of obligations already undertaken.

16.4. The Buyer's access to the online store or their account may be restricted or terminated without notice if the Seller suspects that the Buyer poses a security risk to the store or violates their obligations.

16.5. These Terms are prepared in accordance with the laws of the Republic of Lithuania.

16.6. The laws of the Republic of Lithuania apply to these Terms.

16.7. Any disputes arising from the execution of these Terms will be resolved through negotiations. If no agreement is reached, disputes will be resolved according to the laws of the Republic of Lithuania.
